UBERFAN receives your information through your access or use of products and services— including, without limitation, various software applications (such as mobile and web applications) websites, APIs, SMS, email notifications, buttons and widgets (collectively, the “Services”). By accessing or using any of our Services, including, without limitation, when you submit, post, display or otherwise make available on, to, through or by means of the Services any data, information, links, text, graphics, images, photos, videos, audio, music, files or other materials (collectively, “Content”), you understand, agree and consent to the collection, transfer, manipulation, storage, disclosure, sharing and public display and other uses of your information as described in this Privacy Policy. This means that other users may search for, see, use, or share any of your Content that you make publicly available on, to, through or by means of the Services, consistent with the terms and conditions of this Privacy Policy and our Terms of Service (http:// uberfan.com/terms). When you register to create an UBERFAN account, you provide personal information such as your full legal name, username, email address, password, birthday, gender, phone number and any information contained in your device’s address book or a similar application if you use auto-fill when you register to create an UBERFAN account. Some of this information, for example, your name and username, is listed publicly on our Services, including on your profile page and in search results. Some Services, such as search, do not require registration.


You may provide us with profile information to make public, such as a short biography, your location, your website, favorite team or a profile picture. You may provide information to customize your account, such as a phone number for the delivery of SMS messages. We may use your contact information to send you information about our Services or to market to you. You may access your profile to unsubscribe from certain UBERFAN notifications. We may use your contact information to help others find your UBERFAN account, including through third party services and client applications. You may choose to upload your device’s address book or a similar application so that we can help you invite people to use UBERFAN or find UBERFAN users you know. We may later suggest users to follow on UBERFAN based on your imported address book contacts or contacts from a similar application, which you can delete from UBERFAN at any time. If you email us, we may keep your message, email address and contact information to respond to your feedback or request. If you connect your UBERFAN account to your account on another service (e.g., Facebook, Twitter) in order to cross-post between UBERFAN and that service, the other service may send us your registration or profile information on that service and other information that you authorize. This information enables cross-posting, helps us improve the Services, and is deleted from UBERFAN within a few weeks of your disconnecting from UBERFAN your account on the other service. Providing any of the additional information described in this section is entirely optional and voluntary.


Our Services are primarily designed to help you share Content with the world. Most of the Content that you submit, post, display or otherwise make available on, to, through or by means of the Services is Content you are asking us to make public. This includes, without limitation, photos, videos, comments, Content you bump, or any Content and the metadata related to and provided with such Content, lists you create, users you follow, and many other pieces of Content that result from your access to and use of the Services. Your public Content is broadly and instantly disseminated. For example, your public user profile information and public Content may be searchable by search engines and are immediately delivered via SMS and our APIs to a wide range of users and services. When you share any Content, such as photos, videos and comments, you should think carefully about what you are making public.


You may choose to publish your location on, to, through or by means of the Services and in your UBERFAN profile. You may also tell us your location when you enable your computer or mobile device to send us location information. You can set your location preferences on UBERFAN in your profile and/or in your device’s settings. We may use and store information about your location to provide features of our Services, such as posting Content with your location, and to improve and customize the Services, for example, to provide you with more relevant Content or ads, or to suggest users for you to follow.


UBERFAN may keep track of how you interact with links across our Services, including, without limitation, our email notifications, third party services, and client applications, by redirecting clicks or through other means. We do this to help improve our Services, provide more relevant Content and advertising, and be able to share aggregate click statistics, such as how many times a particular link was clicked. We are not responsible for the practices employed by any mobile or web application or any other service linked to or from our Services, including, without limitation, the information or Content contained within them. When you use a link to go from our Services to another mobile or web application or any other service, our Privacy Policy does not apply to those third party mobile or web applications or any other services. Your browsing and interaction on, to or through any third party mobile or web application or any other service, including, without limitation, those that have a link on our mobile and web applications, are subject to that third party’s own terms, conditions, rules and policies. You understand and agree that UBERFAN is not responsible and does not have control over any third parties that you authorize to access your account or Content. If you are using a third party mobile or web application or any other service and you allow them to access your account or Content, you do so in your sole discretion and at your own risk.


When you access or use the Services, we may use cookies and similar technologies like pixels, web beacons, and local storage (much like many other applications in the market) to collect information about how you use UBERFAN and the Services and to provide and improve our Services for you. We may ask advertisers or other partners to serve ads or services to your devices, which may use cookies or similar technologies placed by us or a third party. A cookie is a small data file that is transferred to your computer’s or device’s hard disk. UBERFAN may use both session cookies and persistent cookies to provide our Services, to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to customize and improve our Services. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some of the Services used to provide our experiences for your enjoyment may not function properly if you disable cookies.


Our servers automatically record information (“Log Data”) created by your use of the Services. Log Data may include, without limitation, information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms and cookie information. We receive Log Data when you interact with our Services, for example, when you visit our applications or websites, sign into our Services, interact with our email notifications, use your UBERFAN account to authenticate to a third party application or website, or visit a third party website that includes an UBERFAN button or widget. UBERFAN uses Log Data to provide our Services and to measure, customize, and improve them. Some features of the Services used to provide our experiences for your enjoyment may not function properly if use or availability of Log Data is impaired or disabled.


UBERFAN uses a variety of third party products and services to help provide our Services, such as hosting our various blogs and wikis, and to help us understand the use of our Services, such as Google Analytics. These third party products and service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address.


In addition to some of the specific uses of information already described in this Privacy Policy, we may use information that we receive to: (i) help you efficiently access your information after you sign in to the Services; (ii) remember information so you will not have to re-enter it during your visit or the next time you visit the Services; (iii) provide personalized content and information to you and others, which may include ads or other forms of marketing; (iv) provide, improve, test and monitor the effectiveness of our Services; (v) develop and test new services, products and features; (vi) monitor metrics such as the total number of visitors, traffic, and demographic patterns; (vii) diagnose or fix technology problems; and (viii) automatically update the UBERFAN application on your device or other users may run contests, special offers, or other events or activities (“Events”) on the Services. If you do not want to participate in an Event, do not use the particular metadata (e.g., hashtag or geotag) associated with that Event.


We do not disclose your private personal information except in the limited circumstances described in this section.


We may share or disclose your information at your direction, such as when you authorize a third party web client or application to access your UBERFAN account.


We engage third party service providers to perform functions and provide services to us in the United States and abroad so that we may provide you with, understand and improve the Services. We may share your public or private personal information with such third party service providers subject to confidentiality obligations consistent with this Privacy Policy, and to the condition that the third parties use your public or private personal data only on our behalf and pursuant to our instructions.


We may share or disclose your non-private, aggregated, anonymized, or otherwise non-personal information, such as your public user profile information, public Content, the users you follow or that follow you, or the number of users who clicked on a particular link (even if only one did).


Notwithstanding anything to the contrary in this Privacy Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, rule, regulation or legal request to: (i) protect the safety of any person; (ii) address fraud, security or technical issues; (iii) or to protect UBERFAN’s rights or property. However, nothing in this Privacy Policy is intended to limit any legal defense or objections that you may have to a third party’s, including government’s, request to disclose your information.


In the event that UBERFAN is involved in a bankruptcy, dissolution, liquidation, merger, acquisition, reorganization or sale of assets, your information, account and Content may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information, account and Content as transferred to the new entity.


Your information collected through the Services may be stored and processed in the United States or any other country in which UBERFAN or its third party service providers maintain facilities. UBERFAN, its affiliates, or third party service providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection law as your jurisdiction. By registering for and using the Services you consent to the transfer of information to the U.S. and to any other country in which UBERFAN, its affiliates, or third party service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy. We use commercially reasonable safeguards to help keep the information collected through the Services secure and take reasonable steps (such as requesting a “strong” and unique password) to verify your identity before granting you access to your account. However, UBERFAN cannot ensure the security of any information you transmit to UBERFAN or the Services or guarantee that information on the Services may not be accessed, disclosed, altered, or destroyed. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and UBERFAN, at all times. Your privacy settings may also be affected by changes the social media services you connect to UBERFAN make to their services. We are not responsible for the functionality, privacy, or security measures of any other organization.


If you are a registered user of our Services, you can modify the personal information that you have provided us with and that is associated with your UBERFAN account by visiting your personal profile. You can also deactivate your UBERFAN account in your personal profile. Deactivating your account allows you to remove your profile without permanently deleting it. After you deactivate your account, it will no longer be viewable, but your information is saved in case you need to reactivate your account because it was accidentally or wrongfully deactivated or if you want to reactivate your account at some time in the future because you changed your mind. If you want to permanently delete your account, please contact us at privacy@uberfan.com with a request that we delete your account. Upon review, we will then take steps to delete your information, account and Content as soon as practicable within a commercially reasonable time, but we may retain some information and Content for backup, archival, record or audit purposes and as otherwise required by law.


Our Services and Content are not directed to persons under the age of 13. If you become aware that your child has provided us with personal information without your consent, please contact us at privacy@uberfan.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to promptly remove such information and terminate the child’s account.


UBERFAN may revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our use of your information and will be posted on this page. If we make a change to this Privacy Policy that, in our sole discretion, is material, we will attempt to notify you. By continuing to access or use the Services after those changes become effective, you understand and agree to be bound by the revised Privacy Policy, regardless of whether you received notice from us. You are responsible for regularly reviewing this Privacy Policy.


The effective date of this Privacy Policy is April 15, 2013. This Privacy Policy was written in English (U.S.). To the extent any translated version of this Privacy Policy conflicts with the English version, the English version controls.
